LIMITED COPYRIGHT LICENSE AGREEMENT
The Wispact Trust Documents are the property of Wispact, Inc. and are protected by copyright and other intellectual property law. You may not adapt or incorporate text contained within the Wispact Trust Documents into other documents. These documents may not be reproduced, rented, leased, lent, sold or otherwise transferred, distributed or made available to others in any form or by any means, electronic or mechanical, including photocopying, screen prints, scanning, posting on the Internet, emailing, or by any information or retrieval system by anyone without the prior written authorization of Wispact, Inc. All rights are reserved.
Wispact, Inc. grants you a non-exclusive license to one copy of the Wispact Trust Documents from which you may reproduce and complete, without altering any language, one set of documents for the sole purpose of creating or amending an individual Wispact trust sub-account for the benefit of an individual person in the course of your professional law practice. For this purpose, you will send the original set of completed documents to Wispact, Inc. and
- you may make another original set or a copy of the original set of completed documents, but not both, for each of the following:
- your client;
- another party to the transaction such as the creator, the beneficiary, or a court;
- another party in any court proceedings involving the transaction;
- government agencies providing public benefits to the beneficiary or creator;
- your co-counsel, if any, and
- your file.
Except as provided herein, you may not make or distribute copies of blank or completed Wispact Trust Documents. Other attorneys interested in using the documents should be directed to obtain them from the Wispact website.
This license applies to all Wispact Trust Documents to which you are about to be or have previously been granted access and shall remain in effect only for so long as you are in compliance with the terms and conditions of this licensing agreement.
The “Wispact Trust Documents” include but are not limited to instructions, frequently asked questions and answers, the master trusts and form templates such as court orders, contribution agreements, applications, asset transfer and designation of sub-account records, court orders, powers statements, distribution amendments, advisor amendments, contact and planning information and the like used to create or amend sub-accounts within the Wispact trusts.
The Wispact Trust Documents are exclusively designed for the purpose of establishing and governing a Wispact Trust sub-account. The authors, contributors and Wispact Inc. make no guarantees as to the adequacy, accuracy or completeness of any phrase, form or any content, and accept no responsibility for errors, omissions or results obtained. It is the responsibility of you, the attorney, to determine whether the materials will accomplish the desired objectives for the client, for the jurisdiction, or for any other intended permitted use. Wispact, Inc. expressly disclaims all warranties, including the warranty of merchantability, warranty of fitness for a particular purpose, or any other warranties, express or implied.
You are responsible for advising your client about how the Wispact trust sub-account affects tax obligations and public benefits of the creator, settlor and beneficiary, completion of the Wispact Trust Documents, obtaining necessary court orders, monitoring the funding of the individual trust account, reporting the creation and funding to government officials, and defending and appealing any related adverse government rulings resulting from your discharge of these responsibilities. Wispact, Inc. is not acting as your attorney or your client’s attorney and is not liable for any direct, indirect, or consequential damages resulting from your use of the Wispact Trust Documents. You also agree to notify Wispact of any adverse government ruling, and agree that Wispact may, if it chooses, intervene or otherwise participate in any such case in order to adequately represent any interest that Wispact may have.
By downloading, copying, printing or otherwise accessing, reproducing, completing and distributing the Wispact Trust Documents, you state you are an attorney at law authorized to practice law in Wisconsin and acknowledge you have read this limited copyright licensing agreement and you will be bound by its terms.
