Legal Details of the WisPACT Trusts are on this page.
WisPACT Trust I
This pooled trust is designed to hold funds belonging to people of any age with disabilities who become beneficiaries of trust accounts funded with their funds. We call these Beneficiary-Funded accounts.
- Sources of funds include personal injury proceeds, divorce proceeds, sale of a home while receiving public benefits, inheritances received outright and back payments of Social Security and other disability benefits payable to the person who will be the trust beneficiary.
- Distributions may be made only to benefit the Beneficiary and not anyone else. See the supplemental needs guide below and the Advisor Information page for more information about distributions.
- When the Beneficiary dies, anything left may be transferred to a Trust I account for a Beneficiary's disabled family member. If that option is not chosen, Medicaid is paid back first, before anything may be spent on the Beneficiary's funeral or distributed to heirs. If the amount left is too small to fully pay Medicaid back, it is kept in the trust to be used for other disabled people.

WisPACT Trust II
This community trust is designed to hold funds of family members and friends of the person who will be the trust beneficiary. We call these Third Party Funded accounts. Beneficiaries may be people of any age with disabilities.
- Sources of funds include inheritances left to trust accounts by spouses, parents, grandparents and others in their wills and estate plans. Trust II can also hold lifetime gifts from others whose income and assets are not deemed to belong to the Beneficiary, such as parents of minors and spouses in some cases.
- Generally, distributions may be made only to benefit the Beneficiary and not anyone else, although this can be altered with the Gifting Distributions Amendment provided below. See the supplemental needs guide below and the Advisor Information page for more information about distributions.
- When the Beneficiary dies, anything left may be spent on the Beneficiary's funeral and then distributed to heirs.
